Plain terms for using Simulant. The short version: our results are simulations to inform your judgement, not guarantees — use them well.

Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services of Simulant Labs Pty Ltd (“Simulant”, “we”, “us”). By using them, you agree to these Terms. If you are using Simulant on behalf of an organisation, you agree on its behalf.

The service

Simulant provides population simulation software that models how synthetic populations may respond to messages, policies, and creative. Access may be provided under a separate order or agreement, which prevails over these Terms if there is a conflict.

Nature of simulated results

This matters, so we'll be direct. Simulant produces simulations, not certainties. Results are modelled estimates intended to inform judgement, not to replace it.

You are responsible for the decisions you make using our outputs. Simulant does not warrant that any simulated result will match real-world behaviour, and you should not present simulated figures as measured survey results.

Acceptable use

You agree not to:

  • Use the service unlawfully, or to deceive or harm others.
  • Attempt to re-identify individuals from any output.
  • Reverse engineer, resell, or misrepresent the platform or its results.
  • Interfere with the security or integrity of the service.

Intellectual property

We own the platform, models, and all related intellectual property. You retain ownership of the inputs you provide, and you receive the rights to use the outputs generated for you as set out in your agreement with us.

Confidentiality

Each party will protect the other's confidential information and use it only to perform under these Terms. We treat your inputs and results as confidential to you.

Disclaimers

The service is provided “as is” and, to the maximum extent permitted by law, without warranties of any kind. Some jurisdictions do not allow certain exclusions, and nothing here limits rights that cannot lawfully be limited.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability arising from the service is limited to the amount you paid us in the twelve months before the claim.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know. Continued use after changes take effect means you accept the updated Terms.
